The first IAS Lecture on Frontier in Humanities will be presented by Prof. Rostam J. NEUWIRTH, Senior Research Fellow of IAS (New Opportunities at the Intersection of Humanities and Sciences), Head for Department of Global Legal Studies, FLL. The lecture will take a combined mode of physical and virtual participation. The topic is Legal Synaesthesia and the Regulation of “Fake News” and more details are provided below:

Legal Synaesthesia and the Regulation of “Fake News” 


摘要 Abstract:
The beginning of the 21st century saw an apparent change in the terminology featured in public debates characterized by the rise of so-called “essentially oxymoronic concepts”, i.e. mainly oxymora and paradoxes. In earlier times, these rhetorical figures of speech were largely the domain of literature, the arts or mysticism. Today, however, many new technologies and other innovative phenomena are contributing to their rise also in the domains of science and of law. Particularly in law, their inherent contradictory quality of combining apparently antagonistic suppositions challenges the traditional dualistic mode of reasoning and binary logic. This challenge derived from changes in law and logic may indicate the imminence of a cognitive revolution, which the lecture will try to exemplify by the regulatory debate surrounding “fake news”. The term “fake news” has received further attention globally in the wake of the Covid pandemic and the so-called “misinfodemic” was found to spread faster than the virus itself. Interestingly, the term “fake news” was also qualified as an oxymoron, which may demonstrate the need for a new and more integrated theory of the senses and their role in law, as captured by the term “legal synaesthesia”. At the same time, this qualification may also call for inquiries into the deeper premises that guide our legal thinking and the role of the senses and the mind in processing information received by them. To this end, the lecture will briefly revisit the existing international framework governing fake news and, based on a series of selected reports on the pandemic, examine future regulatory steps in light of the shortcomings of a strictly dichotomous distinction between falsity or truth and fact or fiction.
